Terms of Service

1. Agreement to Terms

By accessing or using BIT2XMR ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our service.

These Terms constitute a legally binding agreement between you and BIT2XMR. We reserve the right to modify these Terms at any time. Your continued use of the service after changes are posted constitutes acceptance of the modified Terms.

2. Service Description

BIT2XMR is a cryptocurrency swap service that facilitates peer-to-peer exchanges between Bitcoin (BTC) and Monero (XMR). Our service:

  • Provides a platform for users to exchange Bitcoin for Monero
  • Generates unique Bitcoin deposit addresses for each swap transaction
  • Locks exchange rates at the time of swap confirmation
  • Automatically processes swaps after Bitcoin blockchain confirmations
  • Deletes all transaction records within two hours of swap completion

We do not hold, custody, or control your funds beyond what is necessary to facilitate the swap. We are not a wallet service, exchange, or financial institution.

3. Eligibility and Use Restrictions

Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements in your jurisdiction to use our service. You represent and warrant that:

  • You are of legal age in your jurisdiction
  • You are not located in a jurisdiction where cryptocurrency services are prohibited
  • You will comply with all applicable laws and regulations
  • You will not use our service for illegal purposes

Prohibited Uses

You agree NOT to use our service to:

  • Violate any applicable laws or regulations
  • Engage in money laundering, terrorist financing, or other illegal activities
  • Evade taxes or other financial obligations
  • Facilitate fraud, scams, or other criminal activities
  • Interfere with or disrupt the service or servers
  • Attempt to reverse engineer or compromise the security of the platform
  • Use automated systems to abuse or exploit the service

4. User Responsibilities

You are solely responsible for:

  • Verifying Addresses: Double-checking all Bitcoin deposit addresses and Monero receiving addresses before sending funds. We cannot recover funds sent to incorrect addresses.
  • Verifying Amounts: Ensuring the exact amount of Bitcoin sent matches the amount specified in your swap. Sending incorrect amounts may result in swap failure.
  • Using Your Own Wallet: Sending Bitcoin from a wallet you control. We strongly recommend against sending directly from exchanges, as this may cause delays or failures.
  • Securing Your Information: Protecting your Order ID and transaction details. Once deleted (after two hours), this information cannot be recovered.
  • Compliance with Laws: Ensuring your use of our service complies with all applicable laws, regulations, and tax obligations in your jurisdiction.
  • Transaction Fees: Paying any network fees required for Bitcoin transactions. These fees are separate from our service fee.

5. Fees and Exchange Rates

Service Fee

BIT2XMR charges a 0.5% transaction fee on each swap. This fee is deducted from the Monero amount you receive. The fee is transparent and clearly displayed before you confirm your swap. There are no hidden fees.

Exchange Rates

Exchange rates are based on real-time market prices from reputable sources and are updated every 30 minutes. The rate is locked when you confirm your swap, protecting you from price fluctuations during Bitcoin confirmation times. You will see the exact amount of Monero you will receive before confirming.

Network Fees

Bitcoin network fees are separate from our service fee and are determined by the Bitcoin network based on transaction size and network congestion. You are responsible for paying these fees when sending Bitcoin. Monero network fees are included in the amount you receive.

6. Transaction Process and Timing

When you initiate a swap:

  1. You provide the amount of Bitcoin to swap and your Monero receiving address
  2. You review and confirm the exchange rate and fees
  3. You receive a unique Bitcoin deposit address
  4. You send Bitcoin to the deposit address (the rate is locked at confirmation)
  5. We wait for Bitcoin blockchain confirmations (typically 1-3 confirmations)
  6. Once confirmed, we automatically send Monero to your specified address
  7. All records are deleted within two hours of completion

Most swaps complete within 10-15 minutes after Bitcoin confirmation, depending on network conditions. Bitcoin confirmations typically take 10-30 minutes, depending on network congestion and the fee you paid.

Important: Once you send Bitcoin and the transaction is confirmed on the blockchain, the swap cannot be canceled or reversed. Blockchain transactions are irreversible. Always verify all details before sending funds.

7. No Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the service will be uninterrupted, secure, or error-free
  • Warranties regarding the accuracy, reliability, or availability of exchange rates
  • Warranties that transactions will complete within any specific timeframe
  • Warranties regarding the value, stability, or performance of Bitcoin or Monero

We do not guarantee that the service will meet your requirements or that any errors will be corrected. We reserve the right to modify, suspend, or discontinue the service at any time without notice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIT2XMR, ITS OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use
  • Losses resulting from incorrect addresses, wrong amounts, or user error in providing transaction details
  • Losses resulting from blockchain network issues, delays, or failures
  • Losses resulting from price fluctuations in Bitcoin or Monero
  • Losses resulting from service interruptions, technical failures, or security breaches
  • Losses resulting from regulatory actions, legal changes, or force majeure events

Our total liability for any claims arising from or related to the service shall not exceed the amount of fees we received from your specific transaction, or $100 USD, whichever is less.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Risk Disclosures

Cryptocurrency transactions involve significant risks. By using our service, you acknowledge and accept the following risks:

Cryptocurrency Volatility

The value of Bitcoin and Monero can fluctuate dramatically. While we lock exchange rates at confirmation, market conditions may change significantly during confirmation times.

Blockchain Risks

Blockchain networks may experience congestion, delays, or technical issues. Transactions may take longer than expected or fail entirely. We have no control over blockchain networks.

Irreversibility

Cryptocurrency transactions are irreversible once confirmed on the blockchain. If you send funds to the wrong address or the wrong amount, recovery may be impossible.

Regulatory Risks

Cryptocurrency regulations vary by jurisdiction and may change. Your use of our service may be subject to legal restrictions in your location. You are responsible for compliance with applicable laws.

Technical Risks

Software bugs, security vulnerabilities, or technical failures may result in loss of funds. While we implement security measures, no system is completely secure.

No Insurance

We do not provide insurance or guarantees. Your funds are not protected by deposit insurance or similar protections. Use our service at your own risk.

10. Data and Privacy

Our privacy practices are detailed in our Privacy Policy. Key points:

  • We do not require KYC verification or personal information
  • We do not collect email addresses, phone numbers, or identifying data
  • All Order IDs and transaction records are deleted within two hours of swap completion
  • We do not maintain long-term records or databases of transactions
  • We cannot provide transaction history or records after deletion

By using our service, you acknowledge that we cannot recover or provide access to deleted transaction data, even for support purposes.

11. Service Availability and Modifications

We reserve the right to:

  • Modify, suspend, or discontinue the service at any time without notice
  • Change fees, exchange rate sources, or service features
  • Refuse service to anyone for any reason, including suspected illegal activity
  • Implement transaction limits or restrictions
  • Block or restrict access from certain jurisdictions

We do not guarantee that the service will be available at all times or that it will be free from errors, interruptions, or delays. We are not liable for any losses resulting from service unavailability.

12. Support and Dispute Resolution

Support

We provide support on a best-effort basis. Due to our privacy practices and lack of long-term records, our ability to resolve issues is limited. If you need support:

  • Email us at support@bit2xmr.com with your Order ID (if still available - remember they're deleted after two hours)
  • Provide transaction details and blockchain transaction IDs
  • We aim to respond within 24 hours, but cannot guarantee resolution

Disputes

If you have a dispute with us, you agree to first contact us to attempt to resolve it. If we cannot resolve the dispute, you agree that any disputes will be resolved through binding arbitration or in accordance with applicable law, depending on your jurisdiction.

13. Intellectual Property

The BIT2XMR service, including its design, text, graphics, logos, and software, is owned by BIT2XMR and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our service or content without permission
  • Reverse engineer or attempt to extract source code
  • Use our trademarks or branding without authorization
  • Create derivative works based on our service

You retain ownership of any content you provide, but grant us a license to use it as necessary to provide the service.

14. Indemnification

You agree to indemnify, defend, and hold harmless BIT2XMR, its operators, affiliates, and service providers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the service
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your infringement of any third-party rights
  • Any errors or mistakes you make in providing transaction details

15. Termination

We may terminate or suspend your access to the service immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Suspected illegal activity or fraud
  • Abuse or exploitation of the service
  • Any other reason we deem necessary

You may stop using the service at any time. However, any pending transactions will be processed according to these Terms, and we will retain necessary data until transactions complete and deletion occurs.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the service shall be resolved in accordance with applicable law in your jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full effect.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Material changes will be prominently displayed on our website.

Your continued use of the service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the service.

Because we do not collect contact information, we cannot notify you directly of changes. It is your responsibility to review these Terms periodically.

Note: Due to our privacy practices, we may not be able to verify your identity or associate your inquiry with a specific transaction. Please provide your Order ID (if still available) when contacting us about a specific transaction.

19. Acknowledgment

BY USING BIT2XMR, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. YOU ACKNOWLEDGE THAT CRYPTOCURRENCY TRANSACTIONS INVOLVE SIGNIFICANT RISKS, AND YOU USE OUR SERVICE AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL TRANSACTION DETAILS BEFORE SENDING FUNDS.
